| The problem of bog erosion is a man made problem and of all people some of the most worried about erosion are the " BIG OIL Co's " When pipe lines that were 6 feet under ground are now 3 feet above ground the alarm bells start to go off. Yes now " BIG OIL " is the new tree hugger. Until the George Walker Bush Administration started trying to sell off the wet lands ( under the table via small tweaks in the law and regulations to increase the development of the New Orleans wet lands. Pipe lines make lousy bridges and " BIG OIL " is working to restore the wet lands. I guarantee that those pipes will be covered up and new trees will be growing around them …. Panel Says Studies Foresaw Failure, Urges New Scrutiny

An organization of civil engineers yesterday questioned the soundness of large portions of New Orleans's levee system, warning that the city's federally designed flood walls were not built to standards stringent enough to protect a large city.
….The group faulted the agency responsible for the levees, the Army Corps of Engineers, for adopting safety standards that were "too close to the margin" to protect human life. It also called for an urgent reexamination of the entire levee system, saying there are no assurances that the miles of concrete "I-walls" in New Orleans will hold up against even a moderate hurricane.
…The American Society of Civil Engineers panel is one of three independent teams investigating the failure of the New Orleans levees, and until now it has been the most cautious in its public criticisms. The other investigating teams quickly endorsed its findings.
….."We agree that every single foot of the I-walls is suspect," said Ivor van Heerden, leader of a Louisiana-appointed team of engineers. "When asked, we have constantly urged anyone returning to New Orleans to exercise caution, because the system now in place could fail in a Category 2 storm. It has already failed during a fast-moving Category 3 storm that missed New Orleans by 30 miles."

The RNC should be nervous. Check this update on the Democrat primaries
IL-06: Tammy Duckworth. One of the premier races in the country -- and best opportunities for a Democratic pick-up -- has now taken shape. Illinois' 6th is the district left open by Henry Hyde's retirement, who you may remember as a chief architect of the Clinton impeachment. Not missing a beat, the Republicans are running a former Tom DeLay aide who got some of his first seed money in his first race from "the Hammer" himself. He'll have to stack that record up against Democrat Tammy Duckworth's, who became a leading advocate for veterans after losing both her legs to hostile fire in Iraq. She's an intensely impressive voice for Democratic values on everything from foreign policy to education, and this race will be front and center on everybody's radar screen. __
IL-08: Melissa Bean. The Illinois primaries also bring into focus another hot race. In 2004, one of the Democratic heroes was Melissa Bean, who ran an amazing upstart campaign to unseat 34-year Congressman Phil Crane. Her race may have been the biggest upset of the year, but the fact that she's a freshman Congresswoman in a district that went heavily for Bush has the Republicans foaming at the mouth. They know that if they can't get her out this time, it will just get harder and harder every election, so no surprise that RNC Chairman Ken Mehlman himself was up in Illinois to "rally the troops" this week. After a Republican primary where Republicans fought hard to prove they would rubber stamp President Bush's agenda, David McSweeney came out as the Republican nominee after spending more than a $1 million of his own money. Melissa Bean is ready to take him on, and her record of fighting for her district will be her best weapon. __But as those campaigns get going, there's one race that's already in its final phases... __
CA-50: Francine Busby. Out in San Diego the special election to fill Duke Cunningham's seat is in full swing. And while Republicans are busy fighting each other in the primary, Francine Busby is kicking into high gear. Her aggressive anti-corruption message is getting traction, and she's already passed the $1 million fundraising threshold. This is a seat Republicans have taken for granted for years, but Francine is ready for the challenge. __And here's a sampling of some of our other great challengers across the country... __
IN-08: Brad Ellsworth. Republican John Hostettler just may be the most divisive Republican in Congress. "Like a moth to a flame, Democrats can't help themselves when it comes to denigrating and demonizing Christians" -- so said Hostettler on the House floor last year. That's not representation, that's just absurd. Hostettler also made a national name for himself as one of just 11 House Members who voted against funding for reconstruction after Hurricane Katrina. And while Hostettler will have the extreme right behind him, he's run smack into one of the most formidable Democratic challengers anywhere, Sheriff Brad Ellsworth of Vanderburgh County. Ellsworth is an established star, having earned innumerable awards during his tenure as Sheriff, and his staggering fundraising advantage over Hostettler reflects that. Come November, this district could well replace one of the Republicans' chief hatchet men with a leader of a new generation of Democrats. As one local headline read recently, "Both parties see Hostettler-Ellsworth contest as pivotal." __
Connecticut: Farrell, Murphy, Courtney. As the Republican Party has lurched further and further to the right, deeper and deeper into the culture of corruption, Connecticut Republicans have been left out on a limb as they try to play moderate back home while staying in the good graces of their party bosses like President Bush and Tom DeLay. This year, three proud Democrats will make sure they don't get away with it again. __
CT-02: Joe Courtney. Democrat Joe Courtney is taking on Republican rubber stamp Rob Simmons. Rob Simmons is always in danger, and the only thing that has saved him has been big dollars from Tom DeLay and friends -- but this time Tom DeLay may not be so much help. And in one of the most Democratic seats held by a Republicans, Simmons' attacks on John Murtha may not go over so well. __
CT-04: Diane Farrell. Diane Farrell, a leader in an amazing crop of Democratic women running for Congress this year, is hoping to finish what she started last cycle when she came within inches of beating Republican faux-moderate Chris Shays. Shays has been a complete loyalist to the White House on Iraq, being trotted out any time they need a so-called "moderate" to parrot talking points like "[Al Qaeda] and Iraq, they're like peas in a pod." Now Diane has challenged him to a debate on Iraq, and surprise, he refuses -- then goes and writes another op-ed defending the White House in a conservative newspaper. __
CT-05: Chris Murphy. One of the most dynamic and effective Democrats around, Chris Murphy, is running an outstanding campaign that has put the Republicans on their heels. Republican Nancy Johnson is knee-deep in money from big drug and insurance lobbies, which is not surprising since she was the primary architect of the Republican Medicare bill that's left seniors baffled and without their prescriptions and left those lobbies richer than even they ever dreamed. Murphy's fierce campaigning may mean that seniors have one less Republican to sell them out come November.
Looks like things are off to a good start in the opening rounds of primaries.

For years, conservatives have complained about what they saw as the liberal tilt of federal grant money. Taxpayer funds went to abortion rights groups such as Planned Parenthood to promote birth control, and groups closely aligned with the AFL-CIO got Labor Department grants to run worker-training programs.
In the Bush administration, conservatives are discovering that turnabout is fair play: Millions of dollars in taxpayer funds have flowed to groups that support President Bush's agenda on abortion and other social issues.

| The way out is the same thing that FDR was counting on when he conceived the SOCIAL SECURITY ADMINISTRATION system to "pre-pay" the SOCIAL SECURITY ADMINISTRATION system. It is compound interest . Back in the 1930's 40's interest was paid on the quarter, a 5% bond paid 5% of "face" each quarter.
THE INITIAL TEN YEAR PERIOD WAS TO BE THE RAMP UP TO A PRE-FUNDED SYSTEM.

| IF one looks at the roots of the RNC / Cato/Heritage Alliance in the Lenin-Plan.pdf it is but an extension of the fundamental need for the complete control of all media and speech to influence the moderation of these boards at AARP. The " message " that must sent from the collected opinion of the discussions must be made to conform to the stated goals of the RNC / Cato/Heritage Alliance. Thus appears the " paid poster " or RNC /Cato/Heritage Alliance " operative " . These people must be given a wide latitude to operate ( drive dissent off the board so the operatives may present their case in a contradiction free environment. Note the recent FCC awards of fines for indecency for depicting minors participating in a " orgy " with out showing any "nudity" or indecent actions. This was declared as indecent material. Given Prospero's delicate position with many clients to satisfy a whisper of a problem from a client may produce a "sharp knee jerk" reaction " moderators gone wild ".
IF one further notes the recent IRS threats against the NAACP , a catholic church in Pasadena CA and the Cato/Heritage suggestion that AARP should have it's tax status pulled. Some of Washington's top lobbyists say that they expect to find ways around congressional efforts to impose new restrictions on lobbyists' dealings with lawmakers in the wake of the Jack Abramoff corruption scandal, and that any limits will barely put a dent in the billions of dollars spent to influence legislation.
Though Congress may ultimately vote to eliminate a few of the more visible trappings of special pleading, such as gifts, free meals and luxurious trips, lobbyists say they have already found scores of new ways to buy the attention of lawmakers through fundraising, charitable activities and industry-sponsored seminars. An estimated $10 billion is spent annually to influence legislation and regulations, and that spending is not likely to be diminished by the proposed lobbying changes, these lobbyists contend.

Looking at the chart, the lowest paid also pay the least amount of taxes. On the other hand, business losses from people who CREATE jobs are reflected in the higher taxed groups, reducing their tax rate.
The documents you yanked that chart from have fuller explanations, but are far too detailed to be dicussed here. But I can say, all is not what it appears to be by publishing just one or two charts to make your case.
But... you did make the case by using your chart... who does foot the bills in the USA though. You actually made the case that the rich do pay your way, as federal incoming revenue does mirror the tax % paid in by group.
I hope you're not a criminal defense attorney, by time you're finished, your client would get a life sentence for a parking ticket.

AN ACT
To amend the Federal Food, Drug, and Cosmetic Act to provide for uniform food safety warning notification requirements, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the `National Uniformity for Food Act of 2005'.
SEC. 2. NATIONAL UNIFORMITY FOR FOOD.
(a) National Uniformity- Section 403A of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 343-1) is amended--
(1) in subsection (a)(4), by striking `or' at the end;
(2) in subsection (a)(5), by striking the period and inserting `, or';
(3) in subsection (a), by inserting after paragraph (5) the following:
`(6) any requirement for a food described in section 402(a)(1), 402(a)(2), 402(a)(6), 402(a)(7), 402(c), 404, 406, 409, 512, or 721(a), that is not identical to the requirement of such section.'; and
(4) by adding at the end the following:
`(c)(1) For purposes of subsection (a)(6) and section 403B, the term `identical' means that the language under the laws of a State or a political subdivision of a State is substantially the same language as the comparable provision under this Act and that any differences in language do not result in the imposition of materially different requirements. For purposes of subsection (a)(6), the term `any requirement for a food' does not refer to provisions of this Act that relate to procedures for Federal action under this Act.
`(2) For purposes of subsection (a)(6), a State or political subdivision of a State may enforce a State law that contains a requirement that is identical to a requirement in a section of Federal law referred to in subsection (a)(6) if--
`(A) the Secretary has promulgated a regulation or adopted a final guidance relating to the requirement and the State applies the State requirement in a manner that conforms to the regulation or guidance; or
`(B) the Secretary has not promulgated a regulation or adopted a final guidance relating to the requirement, except that if the Secretary has considered a proposal for a regulation or final guidance relating to the requirement and has, after soliciting public comment, made a determination not to promulgate such regulation or adopt such guidance, which determination is published in the Federal Register, the State may not enforce any requirements in State law that are policies rejected by the Secretary through such determination.'.
(b) Uniformity in Food Safety Warning Notification Requirements- Chapter IV of such Act (21 U.S.C. 341 et seq.) is amended--
(1) by redesignating sections 403B and 403C as sections 403C and 403D, respectively; and
(2) by inserting after section 403A the following new section:
`SEC. 403B. UNIFORMITY IN FOOD SAFETY WARNING NOTIFICATION REQUIREMENTS.
`(a) Uniformity Requirement-
`(1) IN GENERAL- Except as provided in subsections (c) and (d), no State or political subdivision of a State may, directly or indirectly, establish or continue in effect under any authority any notification requirement for a food that provides for a warning concerning the safety of the food, or any component or package of the food, unless such a notification requirement has been prescribed under the authority of this Act and the State or political subdivision notification requirement is identical to the notification requirement prescribed under the authority of this Act.
`(2) DEFINITIONS- For purposes of paragraph (1)--
`(A) the term `notification requirement' includes any mandatory disclosure requirement relating to the dissemination of information about a food by a manufacturer or distributor of a food in any manner, such as through a label, labeling, poster, public notice, advertising, or any other means of communication, except as provided in paragraph (3);
`(B) the term `warning', used with respect to a food, means any statement, vignette, or other representation that indicates, directly or by implication, that the food presents or may present a hazard to health or safety; and
`(C) a reference to a notification requirement that provides for a warning shall not be construed to refer to any requirement or prohibition relating to food safety that does not involve a notification requirement.
`(3) CONSTRUCTION- Nothing in this section shall be construed to prohibit a State from conducting the State's notification, disclosure, or other dissemination of information, or to prohibit any action taken relating to a mandatory recall, civil administrative order, embargo, detention order, or court proceeding involving food adulteration under a State statutory requirement identical to a food adulteration requirement under this Act.
`(b) Review of Existing State Requirements-
`(1) EXISTING STATE REQUIREMENTS; DEFERRAL- Any requirement that--
`(A)(i) is a State notification requirement that expressly applies to a specified food or food component and that provides for a warning described in subsection (a) that does not meet the uniformity requirement specified in subsection (a); or
`(ii) is a State food safety requirement described in section 403A(6) that does not meet the uniformity requirement specified in that paragraph; and
`(B) is in effect on the date of enactment of the National Uniformity for Food Act of 2005, shall remain in effect for 180 days after that date of enactment.
`(2) STATE PETITIONS- With respect to a State notification or food safety requirement that is described in paragraph (1), the State may petition the Secretary for an exemption or a national standard under subsection (c). If a State submits such a petition within 180 days after the date of enactment of the National Uniformity for Food Act of 2005, the notification or food safety requirement shall remain in effect in accordance with subparagraph (C) of paragraph (3), and the time periods and provisions specified in subparagraphs (A) and (B) of such paragraph shall apply in lieu of the time periods and provisions specified in subsection (c)(3) (but not the time periods and provisions specified in subsection (d)(2)).
`(3) ACTION ON PETITIONS-
`(A) PUBLICATION- Not later than 270 days after the date of enactment of the National Uniformity for Food Act of 2005, the Secretary shall publish a notice in the Federal Register concerning any petition submitted under paragraph (2) and shall provide 180 days for public comment on the petition.
`(B) TIME PERIODS- Not later than 360 days after the end of the period for public comment, the Secretary shall take final agency action on the petition.
`(i) IN GENERAL- With respect to a State that submits to the Secretary a petition in accordance with paragraph (2), the notification or food safety requirement involved shall remain in effect during the period beginning on the date of enactment of the National Uniformity for Food Act of 2005 and ending on the applicable date under subclause (I) or (II), as follows:
`(I) If the petition is denied by the Secretary, the date of such denial.
`(II) If the petition is approved by the Secretary, the effective date of the final rule that is promulgated under subsection (c) to provide an exemption or national standard pursuant to the petition, except that there is no applicable ending date under this subparagraph for a provision of State law that is part of such State requirement in any case in which the final rule does not establish any condition regarding such provision of law.
`(ii) NONCOMPLIANCE OF SECRETARY REGARDING TIMEFRAMES-
`(I) JUDICIAL REVIEW- The failure of the Secretary to comply with any requirement of subparagraph (A) or (B) shall constitute final agency action for purposes of judicial review. If the court conducting the review determines that the Secretary has failed to comply with the requirement, the court shall order the Secretary to comply within a period determined to be appropriate by the court.
`(II) STATUS OF STATE REQUIREMENT- With respect to a State that submits to the Secretary a petition in accordance with paragraph (2), if the Secretary fails to take final agency action on the petition within the period that applies under subparagraph (B), the notification or food safety requirement involved remains in effect in accordance with clause (i).
`(c) Exemptions and National Standards-
`(1) EXEMPTIONS- Any State may petition the Secretary to provide by regulation an exemption from section 403A(a)(6) or subsection (a), for a requirement of the State or a political subdivision of the State. The Secretary may provide such an exemption, under such conditions as the Secretary may impose, for such a requirement that--
`(A) protects an important public interest that would otherwise be unprotected, in the absence of the exemption;
`(B) would not cause any food to be in violation of any applicable requirement or prohibition under Federal law; and
`(C) would not unduly burden interstate commerce, balancing the importance of the public interest of the State or political subdivision against the impact on interstate commerce.
`(2) NATIONAL STANDARDS- Any State may petition the Secretary to establish by regulation a national standard respecting any requirement under this Act or the Fair Packaging and Labeling Act (15 U.S.C. 1451 et seq.) relating to the regulation of a food.
`(3) ACTION ON PETITIONS-
`(A) PUBLICATION- Not later than 30 days after receipt of any petition under paragraph (1) or (2), the Secretary shall publish such petition in the Federal Register for public comment during a period specified by the Secretary.
`(B) TIME PERIODS FOR ACTION- Not later than 60 days after the end of the period for public comment, the Secretary shall take final agency action on the petition or shall inform the petitioner, in writing, the reasons that taking the final agency action is not possible, the date by which the final agency action will be taken, and the final agency action that will be taken or is likely to be taken. In every case, the Secretary shall take final agency action on the petition not later than 120 days after the end of the period for public comment.
`(C) EXPEDITED CONSIDERATION- The Secretary shall expedite the consideration of any petition under paragraphs (1) or (2) that involves a request for a notification requirement for a food that provides a warning where the health effect to be addressed by the warning relates to cancer or reproductive or birth defects or is intended to provide information that will allow parents or guardians to understand, monitor, or limit a child's exposure to cancer-causing agents or reproductive or developmental toxins.
`(4) JUDICIAL REVIEW- The failure of the Secretary to comply with any requirement of this subsection shall constitute final agency action for purposes of judicial review. If the court conducting the review determines that the Secretary has failed to comply with the requirement, the court shall order the Secretary to comply within a period determined to be appropriate by the court.
`(d) Imminent Hazard Authority-
`(1) IN GENERAL- A State may establish a requirement that would otherwise violate section 403A(a)(6) or subsection (a), if--
`(A) the requirement is needed to address an imminent hazard to health that is likely to result in serious adverse health consequences or death;
`(B) the State has notified the Secretary about the matter involved and the Secretary has not initiated enforcement action with respect to the matter;
`(C) a petition is submitted by the State under subsection (c) for an exemption or national standard relating to the requirement not later than 30 days after the date that the State establishes the requirement under this subsection; and
`(D) the State institutes enforcement action with respect to the matter in compliance with State law within 30 days after the date that the State establishes the requirement under this subsection.
`(A) IN GENERAL- The Secretary shall take final agency action on any petition submitted under paragraph (1)(C) not later than 7 days after the petition is received, and the provisions of subsection (c) shall not apply to the petition.
`(B) JUDICIAL REVIEW- The failure of the Secretary to comply with the requirement described in subparagraph (A) shall constitute final agency action for purposes of judicial review. If the court conducting the review determines that the Secretary has failed to comply with the requirement, the court shall order the Secretary to comply within a period determined to be appropriate by the court.
`(3) DURATION- If a State establishes a requirement in accordance with paragraph (1), the requirement may remain in effect until the Secretary takes final agency action on a petition submitted under paragraph (1)(C).
`(e) No Effect on Product Liability Law- Nothing in this section shall be construed to modify or otherwise affect the product liability law of any State.
`(f) No Effect on Certain State Law- Nothing in this section or section 403A relating to a food shall be construed to prevent a State or political subdivision of a State from establishing, enforcing, or continuing in effect a requirement relating to--
`(1) freshness dating, open date labeling, grade labeling, a State inspection stamp, religious dietary labeling, organic or natural designation, returnable bottle labeling, unit pricing, a statement of geographic origin, or dietary supplements; or
`(2) a consumer advisory relating to food sanitation that is imposed on a food establishment, or that is recommended by the Secretary, under part 3-6 of the Food Code issued by the Food and Drug Administration and referred to in the notice published at 64 Fed. Reg. 8576 (1999) (or any corresponding similar provision of such a Code).
`(g) Definitions- In section 403A and this section:
`(1) The term `requirement', used with respect to a Federal action or prohibition, means a mandatory action or prohibition established under this Act or the Fair Packaging and Labeling Act (15 U.S.C. 1451 et seq.), as appropriate, or by a regulation issued under or by a court order relating to, this Act or the Fair Packaging and Labeling Act, as appropriate.
`(2) The term `petition' means a petition submitted in accordance with the provisions of section 10.30 of title 21, Code of Federal Regulations, containing all data and information relied upon by the petitioner to support an exemption or a national standard.'.
(c) Conforming Amendment- Section 403A(b) of such Act (21 U.S.C. 343-1(b)) is amended by adding after and below paragraph (3) the following:
`The requirements of paragraphs (3) and (4) of section 403B(c) shall apply to any such petition, in the same manner and to the same extent as the requirements apply to a petition described in section 403B(c).'.
SEC. 3. CONDITIONS.
The amendments made by this Act take effect only if the Secretary of Health and Human Services certifies to the Congress, after consultation with the Secretary of Homeland Security, that the implementation of such amendments will pose no additional risk to the public health or safety from terrorists attacks relating to the food supply.
SEC. 4. ENSURING ADEQUATE INFORMATION FOR INFANTS, CHILDREN, AND WOMEN OF CHILD-BEARING AGE.
Nothing in this Act or the amendments made by this Act shall have any effect upon a State law, regulation, proposition or other action that establishes a notification requirement regarding the presence or potential effects of mercury in fish and shellfish.

S. 2300. A bill to amend the Federal Food, Drug, and Cosmetic Act with respect to market exclusivity for certain drugs, and for other purposes; to the Committee on Health, Education, Labor, and Pensions.
Ms. STABENOW. Mr. President, I rise today to introduce the Lower PRICED Drugs Act. I want to thank Senator TRENT LOTT for joining me on this important legislation, and for his leadership in increasing the availability of affordable generic drugs.
I am very pleased that our legislation is supported by AARP, General Motors Corporation, AFL-CIO, Alliance for Retired Americans, Families USA, the Generic Pharmaceutical Association, the Pharmaceutical Care Management Association, PCMA, the National Association of Chain Drug Stores, and the Coalition for a Competitive Pharmaceutical Marketplace--an organization including large national employers and insurers.
We know that greater availability of generic drugs translates into dramatic savings for consumers, manufacturers, businesses, and taxpayers. Of the 25 top selling drugs in 2004, the only one that did not increase in price was a drug available both in generic and over-the-counter form. And, according to the National Association of Chain Drug Stores, while the average retail price for a brand drug in 2004 was $96.01 the average retail price for a generic was $28.74, a savings of nearly 70 percent.
It's a very well known principle of economics: competition lowers prices.
But we don't need to rely on economic theory; we only have to look at what is happening with drug prices. Of the top five brand name drugs, by retail sales, the average price for 1 month's use of the cheapest among them is just over $76, and the 3rd most popular drug--zocor--is more than $140 per month. That's $1,680 per year for an important drug to lower cholesterol levels. The average price of the most popular five drugs--none of which faces generic competition--is over $114.
There is nothing to hold down the prices of these drugs, and in fact, even though many of them have been on the market for years and years, their prices continue to increase. I first checked the prices of these drugs last November, and then again on Monday of this week. The prices this week are higher, by several dollars in many cases, than they were last year.
However, consider the prices consumers pay for drugs for which there are generic equivalents. The most frequently dispensed generic drugs are hydrocodone, lisinopril, atenolol, amoxicillin and hydrocholorothiazide. Not only are these important drugs, used to treat pain, high blood pressure, and bacterial infections, considerably more affordable than their brand name equivalents, the average generic price is $9.34, representing a savings of more than 60 percent from the average brand price of
$24.74, but the presence of competition has another important effect: The average price of these brand name drugs is a lot lower than the average price of brand drugs that don't face competition.
While the generic provisions in the Medicare Modernization Act, MMA, [Page: S1421] GPO's PDF
made important progress, there still isn't timely competition in the pharmaceutical market.
New loopholes have been found to keep generics off the market, and keep prices higher than they need to be. In fact, in 2004, a year after AMA passed, brand name prescription drug prices rose by 7.1 percent, the biggest single-year price hike in 5 years.
Our bill would close several loopholes that prevent and delay generics from coming to market. It will increase access to affordable generic drugs and save consumers, businesses and Federal health programs billions of dollars annually.
The Lower PRICED Drugs Act would prevent abuse of the current pediatric exclusivity provision. It would ensure that pediatric exclusivity is used as intended, to generate information about the use of drugs in children, and prevent brand drug companies from keeping more affordable generic alternatives of drugs not suitable for children, or never studied in children, off the market.
For example, Pravigard PAC contains two widely used medications: pravastatin, used to lower cholesterol, and aspirin. Despite the fact that aspirin isn't safe in children, the manufacturer received a six-month pediatric extension. What sense does that make?
The manufacturer of Pravigard PAC even includes the following warning in the patient information they put out:
Who should not (manufacturer's emphasis) take PRAVIGARD PAC?
Do not take PRAVIGARD PAC if you: Are 18 years of age or younger. Children younger than 18 years should not use any product with aspirin in it.
Pediatric marketing extensions should not be given for products not suitable for children, like those containing aspirin.
Using pediatric marketing protections to extend brand name monopolies should be reserved for studies that help us learn more about drugs for kids, not to keep lower-cost generic alternatives of drugs for adults off the market.
Our bill would also remove an arbitrary roadblock to the entry of generic versions of certain antibiotics, close a loophole that allows drug companies to use the current complex rules for challenging drug patents as a delaying tactic against the introduction of generics and prevent abuses of the citizen petition process.
I look forward to working with Senator LOTT to create more competition, more choices, and more savings for American consumers of prescription drugs, and I urge colleagues to join us in this effort.

NEW ORLEANS, Louisiana (CNN) -- Three days after officials inspected a storm-damaged home spray-painted with "0" -- indicating no bodies inside -- cadaver dogs led searchers to a victim of Hurricane Katrina in the attic.
Before dying, the man apparently was trying to crawl out of an air-conditioning vent to escape rising floodwaters, said Dr. Louis Cataldie, Louisiana's medical examiner.
Cataldie said searchers expect to find up to 400 more bodies of storm victims still hidden inside New Orleans homes six months after the storm.
Cataldie said Monday that cadaver-searching dogs are critical to the search and recovery missions. (Watch cadaver dogs scour buildings -- :47)
"Obviously my concern is we could clear a house and determine there's no body inside," he said. "So it's important to get these dog teams in before any debris is removed."

Section 1631. Declaration of national emergency by Executive order; authority; publication in Federal Register; transmittal to Congress
When the President declares a national emergency, no powers or authorities made available by statute for use in the event of an emergency shall be exercised unless and until the President specifies the provisions of law under which he proposes that he, or other officers will act. Such specification may be made either in the declaration of a national emergency, or by one or more contemporaneous or subsequent Executive orders published in the Federal Register and transmitted to the Congress.
SUBCHAPTER IV - ACCOUNTABILITY AND REPORTING REQUIREMENTS OF PRESIDENT
Section1641. Accountability and reporting requirements of President
- (a) Maintenance of file and index of Presidential orders, rules and regulations during national emergency
When the President declares a national emergency, or Congress declares war, the President shall be responsible for maintaining a file and index of all significant orders of the President, including Executive orders and proclamations, and each Executive agency shall maintain a file and index of all rules and regulations, issued during such emergency or war issued pursuant to such declarations.
- (b) Presidential orders, rules and regulations; transmittal to Congress
All such significant orders of the President, including Executive orders, and such rules and regulations shall be transmitted to the Congress promptly under means to assure confidentiality where appropriate.
- (c) Expenditures during national emergency; Presidential reports to Congress
When the President declares a national emergency or Congress declares war, the President shall transmit to Congress, within ninety days after the end of each six-month period after such declaration, a report on the total expenditures incurred by the United States Government during such six-month period which are directly attributable to the exercise of powers and authorities conferred by such declaration. Not later than ninety days after the termination of each such emergency or war, the President shall transmit a final report on all such expenditures.
The president does not have to ask any bodies permission to declare a state of national emergency. Blanco and Nagin have no say in the mater. The Commander and Chief has the power.

Three airframes, CH-47A, CH-47B, and a CH-47C, were stripped-down to their basic airframes and then rebuilt with improved systems to provide three CH-47D prototypes. These experts say the Corps, racing to rebuild 169 miles of levees destroyed or damaged by Katrina, is taking shortcuts to compress what is usually a years-long construction process into a few weeks. They say that weak, substandard materials are being used in some levee walls, citing lab tests as evidence. And they say the Corps is deferring repairs to flood walls that survived Katrina but suffered structural damage that could cause them to topple in a future storm.

Topping of the levees was a concern but that would have dumped only few 10's of acre feet of water in New Orleans a real mess but the pumping stations would have had a chance to handle that amount of water. When the levees breached lake Pontcetrain emptied into NO the level of the lake is above the city. Pontcetrain continued to dump water into NO for days. |

| If the levees had been maintained ( sections had sunk 4 feet into the bog, some flood walls had windows , others were skewed not straight in a line ). With the George Walker Bush's continuous budget cuts what could the people do ? a few levee districts tried to raise taxes to fund repairs but they could not raise the money to fix the system just make small repairs.

| George Walker Bush was informed of the abysmal condition of the " NEW LEVEE SYSTEM " that had been built in New Orleans. The levees needed repair and maintenance in addition to funding to Finish the project. Most intelligent people understand if a large wave ( storm surge ) strikes a barrier ( levee wall ) the structure will come under increased external strain because of movement of the water toward the flood wall ( levee wall). This increase in external strain applied to the wall ( levee ) sets up internal stresses in the flood wall ( levee wall ) system. As these internal stresses mount the flood wall( levee wall) system will begin to either move ( in the direction of the applied strain or deform ( rupture) when the design maximum strain is reached. This design maximum is computed with a nominally built structure that is in working order i.e. no holes or large leaks in it , walls standing and positioned in the correct manner not sunk into the bog 4 feet. I don't know how SIMPLE to make the explanation. This levee system could not hold back high tide ( people who lived near the levee would have yard flooding and street flooding, the water came through the levee ) at high tide. Yet the George Walker Bush administration cut SELA funding every year since 2001. This is called Negligent Homicide (1) (2)(3)(4)(5)(6)(7) .

This afternoon on the ABC evening news I saw film clip of a teleconference between George Walker Bush and the National Weather Service . The briefer stated that the New Orleans levees would be toped if New Orleans sustained a direct hit from Katrina. This is a fact.
George Walker Bush was first informed of the massive scale of a cat 4 hurricane hit on New Orleans in his first STA ( Strategic Threat Assessment ) briefing by FEMA in Jan 2001 when he took office.
